COSMO TERMS OF SERVICE

These Terms of Service ("Terms") are a binding agreement between you and Cosmo App LLC ("Cosmo," "we," "us," or "our"). They govern your use of bookwithcosmo.com, app.bookwithcosmo.com, our mobile applications, and related services (the "Services"). Our Privacy Policy explains how we handle personal information, and our Community Guidelines are part of these Terms. SECTION 18 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. If you do not agree, do not use the Services.
1. Who We Are
Cosmo is a community-powered platform that helps people discover, recommend, and book beauty and self-care professionals. Cosmo App LLC is a Delaware limited liability company based in Los Angeles, California.
2. Eligibility and Accounts
(a) You must be at least 18 years old and able to form a binding contract to use the Services. You will be asked to confirm that you are 18 or older when you sign up.
(b) You must give accurate account information, including in the onboarding quiz, and keep it current.
(c) You are responsible for all activity under your account and for keeping your login credentials confidential.
(d) Notify us promptly at support@bookwithcosmo.com of any unauthorized use.
(e) One person per account. You may not create an account for someone else, impersonate anyone, claim a business identity that is not yours, or create an account after we have suspended or terminated you.
3. Cosmo's Role
Cosmo is a technology platform. Beauty and self-care services are provided by independent professionals ("Pros") to the people who book them ("Clients"). Cosmo is not a party to any agreement between a Pro and a Client. Cosmo does not employ Pros and does not provide, supervise, or control their services. We do not guarantee any Pro's qualifications, licensing, availability, pricing, or quality of work. We also do not guarantee the accuracy of any listing, review, or recommendation. Any arrangement for services is solely between the Pro and the Client. Nothing on Cosmo is medical advice.
4. Terms for Clients
(a) Bookings. Booking requests, appointment terms, and cancellation and no-show policies are set by each Pro. Please read them before you book.
(b) Payments. Cosmo does not currently process payments for services. Payment for services, including deposits, tips, and cancellation charges, is arranged directly with the Pro using the Pro's own payment methods. Any deposit or payment policy shown on Cosmo is set by the Pro. Disputes about payments, deposits, refunds, cancellations, or the quality of services are between you and the Pro. If we introduce payment features in the future, we will present additional terms before you use them.
(c) Your responsibility. You are responsible for telling a Pro about any allergies, sensitivities, medical conditions, or other information relevant to your safety, and for asking the Pro whether a treatment is suitable for you, including its risks and aftercare.
5. Terms for Pros
(a) Requirements. You represent and warrant that you and anyone performing services for you: (i) hold every license, permit, and certification required by applicable law, including state cosmetology, barbering, and esthetician board requirements; (ii) for medical, med-spa, tattoo, piercing, or permanent makeup services, hold any additional credentials and maintain any medical supervision that applicable law requires; (iii) comply with all health, sanitation, safety, employment, tax, and consumer protection laws; and (iv) maintain any insurance that applicable law requires. You must give us proof of licensure or insurance on request.
(b) Your listing. You are solely responsible for your profile, pricing, availability, deposit and cancellation policies, and services. Everything you post must be accurate and lawful. This includes your business name, address, credentials, and any optional self-identified business attributes (for example, Black-owned, women-owned, or LGBTQ+-owned). Cosmo does not verify self-identified attributes, and misrepresenting them violates these Terms. You choose whether your full address is shown publicly or shared with a Client only after a booking is confirmed, and you are responsible for keeping it current.
(c) Independent business. You are an independent business. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship with Cosmo.
(d) Plans, subscriptions, and fees. Current plans and prices are shown on our Pricing page (bookwithcosmo.com/pricing) and in the app.
(i) Starter plan. The Starter plan has no monthly fee. When a new client introduced through Cosmo completes their first appointment with you, Cosmo charges you a one-time new-client fee equal to 20% of the price of that first booking, capped at $40.
(ii) Clients introduced through Cosmo. A client is "introduced through Cosmo" when their first booking with you comes from anywhere in Cosmo other than your personal booking link. Examples include when a client finds you by searching or browsing Discover (including Pro Spotlight); is matched with you through the quiz or personalized recommendations; sees your work in the feed, including tapping "Book this look"; taps you when you are tagged or @mentioned in a post, caption, comment, or Group post; finds you in a Cosmo Group; sees you in another user's Cosmo Crew or profile; or reaches you from a Cosmo email, notification, or message.
(iii) Your own clients. A client is your own client, and no fee applies, if they visited your personal booking link (app.bookwithcosmo.com/b/your-username) within the 30 days before their first booking. This includes when you share the link and when a client shares it using the Share button on your profile. An existing client who joins Cosmo and finds you in any of the ways listed in (ii), without using your personal booking link, counts as introduced through Cosmo, so we recommend sending your existing clients your personal booking link. A client's source is set at their first booking with you and does not change afterward. Clients who had already booked with you on Cosmo before new-client fees took effect are treated as your own clients.
(iv) When no fee applies. There is no new-client fee for repeat bookings by the same client; for clients who book through your personal booking link as described in (iii); while you are on a paid plan; or for Founding Professionals during their free period. If a client cancels or does not show up for their first appointment, no fee is charged for that appointment.
(v) Billing. New-client fees are totaled and charged monthly to the payment method you keep on file. Each monthly statement lists every fee and the booking it relates to. We will notify you before we begin charging new-client fees.
(vi) Fee disputes. If you believe a fee was charged in error, for example for a client you brought to Cosmo yourself, contact support@bookwithcosmo.com within 30 days of the statement that shows the fee. We will review the booking records and refund or credit any fee charged in error.
(vii) Pro plan. The Pro plan costs $39 per month, or the price shown at checkout, and includes no new-client fees. Paid subscriptions renew automatically every month at the then-current price, and your payment method is charged each month, until you cancel. Before you subscribe, we show you these renewal terms and ask you to agree to them, and after you subscribe we email you a confirmation that includes them and explains how to cancel. You can cancel online at any time with the "Cancel subscription" button on the Plan page in your account settings, without calling or contacting us. Cancellation takes effect at the end of the current billing period, and you keep paid features until then. We will notify you at least 7 days, and no more than 30 days, before any price change takes effect, and before any free trial or promotional period converts to a paid plan. Except where required by law, fees are non-refundable, and we do not offer prorated refunds for partial billing periods.
(e) Promotions. Founding pro programs, referral codes, and other promotional offers are subject to the terms shown when offered. We may change or end promotions that have not yet been redeemed, as allowed by law, but changes will not reduce benefits already granted to you, including the Founding Professional terms in Section 5(f). We will give at least 30 days' notice before any charge begins at the end of a promotional period, and you may cancel before then at no cost. Codes have no cash value and may not be sold or transferred.
(f) Founding Professionals. A Pro who redeems a founding code receives six months of Pro access at no cost. After that free period, they may subscribe at a locked founding rate of $24 per month for as long as the subscription remains active. If they cancel and later return, the then-current Pro price applies.
(g) Photos of Clients. Before you upload photos, videos, or other media showing a Client's face or likeness, you must obtain every consent and release the law requires, including written model releases where required.
(h) Regulated services. Some Pros offer medical or medical-adjacent services (for example, injectables or laser treatments) or other services subject to specific licensing and health regulation (for example, tattooing, piercing, or permanent makeup). These services are provided solely by the Pro under the Pro's own licensure, permits, and any required medical supervision. Cosmo does not supervise, direct, or control any such service.
6. Community, Groups, Reviews, and Recommendations
(a) Groups and community features let you share recommendations with people you choose. Content shared in a Group is visible to that Group's members, who may share it further.
(b) Reviews and recommendations must reflect your genuine experience. Verified reviews are tied to completed bookings made through Cosmo. You may not: (i) post fake reviews, or reviews of a business you own, work for, or are related to; (ii) offer or accept compensation in exchange for reviews; (iii) suppress or manipulate reviews; or (iv) use reviews to harass or extort.
(c) Pros may not condition services or discounts on positive reviews.
(d) Nothing in these Terms limits your right to post honest reviews as protected by the Consumer Review Fairness Act.
(e) Community content reflects personal opinion. It is not professional, medical, or dermatological advice.
(f) A Group's creator acts as its moderator and may remove posts and comments within that Group. Group moderators act on their own behalf, not as agents of Cosmo, and are responsible for the Groups they create. Cosmo may remove any Group or Group content, or remove a moderator, to enforce these Terms or our Community Guidelines. Deleting a Group may make content shared only to that Group unavailable.
7. Your Content
(a) You keep ownership of the content you submit, such as photos, videos, posts, captions, comments, reviews, recommendations, profile information, interests you create, messages, and materials you send through support or bug reports ("User Content").
(b) You grant Cosmo a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, display, distribute, and otherwise use your User Content. This license covers operating, improving, and promoting the Services. It lasts while your User Content is on the Services and for a reasonable period after removal, subject to our Privacy Policy.
(c) You represent that you have every right needed to post your User Content. This includes consent from anyone identifiable in photos you upload.
(d) Profiles and posts are visible to other signed-in users unless you switch to a private account in Settings. Interests you select or create are private to you.
(e) We may remove User Content at our discretion. We are not obligated to monitor User Content.
8. Prohibited Conduct
Use of the Services is subject to our Community Guidelines. You may not: (a) violate any law or anyone else's rights; (b) submit false, misleading, defamatory, harassing, hateful, sexually explicit, violent, or harmful content; (c) impersonate any person or misrepresent your affiliation, credentials, or licensure; (d) send spam or unsolicited promotions; (e) gain or attempt to gain unauthorized access to the Services or related systems, or get around moderation, suspensions, or verification; (f) scrape, crawl, or harvest data, collect other users' data without consent, or use Services content to train machine learning or AI models, without our written permission; (g) reverse engineer the Services, interfere with their operation, or introduce malware; (h) use the Services to move Clients or Pros you met through Cosmo off-platform to avoid fees owed to Cosmo; or (i) use the Services to offer illegal services or services that require a license you do not hold.
9. Communications
(a) By creating an account or joining the waitlist, you agree to receive electronic communications from us. These include transactional messages about your account and bookings, plus occasional updates about Cosmo's launch, products, and early access. You may opt out of marketing emails at any time using the unsubscribe link. Transactional messages will continue while you have an account.
(b) If you turn on push notifications, we will send alerts about activity on your account, such as new messages and booking updates. You can turn them off at any time in the app or your device settings.
10. Intellectual Property
(a) The Services and their content are owned by Cosmo App LLC or its licensors and protected by intellectual property laws. User Content is excluded. Content includes text, graphics, logos, the Cosmo name, software, and design.
(b) We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose under these Terms. You may not use our trademarks without our prior written consent.
(c) If you send us feedback or suggestions, we may use them without restriction or compensation to you.
11. Copyright Complaints
We respect intellectual property rights. If you believe content on the Services infringes your copyright, send a notice that meets 17 U.S.C. § 512(c)(3) to our designated agent: Courtney Fede, Cosmo App LLC, 8 The Green, Ste A, Dover, DE 19901, support@bookwithcosmo.com. We may terminate repeat infringers' accounts.
12. Third-Party Services
The Services may link to or integrate third-party services, such as sign-in providers, calendars, maps, social media, and the external payment apps a Pro may link to (for example, Venmo, Cash App, Zelle, or Square). Their terms and privacy policies govern your use of them. We are not responsible for third-party services.
13. Health and Safety; Assumption of Risk
Beauty, self-care, med-spa, tattoo, and piercing services can carry inherent risks. These include allergic reactions, skin irritation, infection, scarring, injury, and dissatisfaction with results. You choose and use any Pro at your own risk. Cosmo does not vet Pros. Credentials shown on a Pro's profile (for example, "licensed" or "RN") are provided by the Pro, and Cosmo does not guarantee them.
14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. THESE INCLUDE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. COSMO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. COSMO MAKES NO WARRANTY ABOUT ANY PRO, CLIENT, USER CONTENT, OR SERVICES ARRANGED THROUGH THE PLATFORM.
15. Limitation of Liability
(a) TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMO AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR: (i) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL; OR (ii) ANY DAMAGES ARISING FROM SERVICES PERFORMED BY A PRO OR THE CONDUCT OF ANY USER.
(b) COSMO'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF: (i) THE AMOUNTS YOU PAID COSMO IN THE 12 MONTHS BEFORE THE CLAIM AROSE; OR (ii) $100.
(c) Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, gross negligence, or willful misconduct.
16. Release
To the extent permitted by law, you release Cosmo from claims arising from disputes with other users, including claims about services performed by Pros. If you are a California resident, you waive California Civil Code § 1542. It states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
17. Indemnification
You will defend, indemnify, and hold harmless Cosmo and its members, managers, employees, and agents from third-party claims, losses, and expenses, including reasonable attorneys' fees, arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) if you are a Pro, services you or your personnel provide, your licensure, and your payment practices.
18. Dispute Resolution; Arbitration; Class Action Waiver
(a) Informal resolution. Before filing a claim, you and Cosmo agree to try to resolve the dispute informally for 60 days after written notice. Send notices to support@bookwithcosmo.com, including your name, account email, a description of the dispute, and the relief you want.
(b) Arbitration. Unresolved disputes will be resolved by binding individual arbitration administered by JAMS under its consumer arbitration rules, before a single arbitrator, in Los Angeles County, California, or another location reasonably convenient to you, or by video. The Federal Arbitration Act governs this Section 18.
(c) Exceptions. Either party may bring an eligible individual claim in small claims court, or seek injunctive relief for intellectual property misuse.
(d) Class action waiver. CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
(e) Mass arbitration. If 25 or more similar demands are filed by or with the help of the same counsel, they will be administered in batches under the provider's mass arbitration procedures.
(f) Opt-out. You may opt out of this Section 18 by emailing support@bookwithcosmo.com within 30 days after you first accept these Terms. If you had an account before October 31, 2026, you may opt out within 30 days after October 31, 2026. Include your name, account email, and a clear statement that you want to opt out of arbitration.
(g) Severability. If the class action waiver is found unenforceable, the affected claims will proceed in court as described in Section 19, not in arbitration.
19. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any claims not subject to arbitration will be brought exclusively in the state or federal courts located in Los Angeles County, California. You and Cosmo consent to personal jurisdiction there.
20. Suspension and Termination
(a) You may close your account at any time in Settings.
(b) We may remove content, restrict features, or suspend or terminate your access at any time if you violate these Terms or our Community Guidelines, create risk or legal exposure for us or others, or if required by law. We provide reporting tools but do not guarantee that content is pre-screened. For paid subscriptions, any refund will follow Section 5(d) and applicable law.
(c) Fees you owe under Section 5(d) and Sections 7, 10, and 13 through 22 survive termination.
21. Changes to These Terms
We may update these Terms from time to time. For material changes, we will give notice before they take effect, by email or in the Services. Changes do not apply to disputes that arose before the change. Continued use after the effective date means you accept the updated Terms.
22. General
(a) These Terms and any policies they reference are the entire agreement between you and Cosmo about the Services.
(b) If any provision is unenforceable, the rest remains in effect.
(c) Our failure to enforce a provision is not a waiver.
(d) You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
(e) We are not liable for delays caused by events beyond our reasonable control.
